Notices of Infringement

Infoglide respects the intellectual property rights of others. Infoglide prohibits the posting of any content that infringes or violates the copyright rights and/or other intellectual property rights of any person or entity. Should you believe that your work or property is infringed by any content on the Site, please contact Infoglide at the address shown below. Governing Law and Jurisdiction

By accessing Infoglide’s Site, you agree that all matters relating to your access to, or use of, this Site shall be governed by the laws of the State of Texas without reference to the principles of conflicts of laws thereof. You further consent to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas, for the resolution of any dispute or legal matter arising under or related to your use of the Site.

The submission to Travis County court jurisdiction shall not (and shall not be construed so as to) limit the right of Infoglide to institute proceedings in any other court of competent jurisdiction so far as necessary to enforce its intellectual property rights, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdiction, whether concurrently or not.

Limitation of Liability

IN NO EVENT WILL INFOGLIDE SOFTWARE OR ITS THIRD-PARTY CONTENT PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL OR INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO, DAMAGES RESULTING FROM LOSS OF DATA, LOSS OF USE, LOSS OF OPPORTUNITY, DOWNTIME, LOSS OF GOODWILL, LOSS OF BUSINESS OR ANY HARDWARE MALFUNCTION RESULTING FROM USE OF THE SITE, REGARDLESS OF WHETHER INFOGLIDE SOFTWARE OR ITS REPRESENTATIVES WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF INFOGLIDE SOFTWARE [WHETHER IN CONTRACT, WARRANTY, TORT [INCLUDING NEGLIGENCE WHETHER ACTIVE, PASSIVE, OR IMPUTED], PRODUCT LIABILITY, STRICT LIABILITY, OR OTHER THEORY], ARISING OUT OF OR RELATING TO THE USE OF THE SITE, EXCEED $100.00.

The laws of some US states do not allow limitations on implied warranties, or the exclusion or limitation of certain damages. If these laws apply, some or all of the above disclaimers, exclusions, or limitations, may not apply to you, and you may have additional rights to those contained herein.
